Stokes Supreme Court order
The Supreme Court has released an order in STOKES v DAIMLERCHRYSLER CORPORATION. The Court has ordered oral argument on DaimlerChrysler's application and requested supplemental briefs on the "whether the burden-shifting analysis described in the Court of Appeals opinion...relieved the plaintiff of the burden of proving that he was disabled from all jobs within his qualifications and training, as required by SINGTON v CHRYSLER CORP." You will recall that, while we were pleased with the Court of Appeals' decision in many respects, we were not pleased with the meager burden of proof created by the Court of Appeals ' majority for employees. The Supreme Court now appears poised to more specifically define the employees' burden of proof . Both parties' briefs are due no later than June 8, 2007.
